The use of CommGear Pty Ltd.’s Site is such to the policies, terms and conditions set below. By using this site, you agree to be bound by the Websites Terms of use which are inclusive of our Warranty, Refunds, Returns and Privacy Policies. Terms within the authority of CommGear can modify, alter, or update these terms without prior written notice. All amendments to our policies will be final and continue to reflect the required terms of use.

1. Product

   1. CommGear have supplied specific details of all products, these should be confirmed prior to purchase

   2. Products will be supplied in accordance with the details set out within the site including length, width, thicknesses, markings etc.

   3. Details have been provided to allow our customers the best possible descriptions to not mislead the products displayed

   4. CommGear is unable to warrant or represent that products are free from human or mechanical error, technical inaccuracies or other typographical error or defects upon supply however will work with our Customers to rectify the issue

2. Payment

   1. Full payment including delivery charges are required prior to order acceptance

   1. Copyright is applicable to all content provided on the Site, owed by CommGear Pty Ltd

   3. All content, imagery, specific wording, descriptions, graphics, and information available on the site is protected by copyright, trademark or other intellectual property rights and laws

   4. No imagery, information, details can be copied, reproduced, modified, republished uploaded, posted, transmitted, or distributed in any form or manner without the express written consent of CommGear

   5. Use of the CommGear site does not and will not result in any rights, title or interest to the information provided on the site

   6. Commercial use of the site and information is expressly prohibited under any circumstances

   7. All trademarks and trade names which appear within CommGear’s content, site and imagery are the sole property of CommGear. Use of these trademarks without CommGear’s express written permission is a direct infringement of our intellectual property rights

2. Right to Refuse Service

   1. CommGear hold the right to refuse sale on their own accord

   2. Purchases are based on the conditions set out by CommGear which are not subject to negotiation

   3. Refunds will be issued upon unsatisfactory meeting of set conditions of sale without notice

   4. CommGear reserves the right to suspend or terminate your access to the Site at its sole discretion for any reason

   5. We have the right to refuse or cancel any orders whether or not the order has been confirmed and you have been charged. If your credit card has already been charged for the purchase and your order is cancelled, CommGear will immediately issue a credit to your processed method

3. Pricing

   1. In the event a product is listed at an incorrect price due to an internal error, CommGear have the right to refuse or cancel any orders placed for product listed at the incorrect price and will not uphold the incorrect pricing

   2. Pricing may vary from original calculations based on location specific information and PO Box deliveries

   3. Changes to price may arise without written notice

   4. Charges incurred from changes will still be required prior to order postage

   5. Fees incurred due to payment types including Visa, Debit and Mastercard will be carried by the Customer

4. Delivery

   1. Shipping is applicable for Australia Wide including Tasmania

   2. CommGear will not be held responsible for orders that are lost or damaged during shipping unless postal insurance is chosen and paid for by the Customer

   3. Pricing may vary from original calculations based on location specific information and PO Box deliveries

   4. CommGear provide estimated delivery timelines however cannot be held responsible for delivery issues that arise outside of our control

   5. Damages to products that occur during transit will be assessed on a case-by-case basis and dealt with according to CommGear’s Returns Policy

   6. Delivery fees will be charged based on the product weight and size as we do not offer flat rate shipping

   7. CommGear have limited pick up options available and will be determined on a case-by-case basis

5. Liability

   1. CommGear will in no way be liable to any injury, loss or damage arising in relation to the use or application of our products

   2. Will not be responsible for any direct, indirect, accidental, special, or consequential loss or damages that may occur as a result

   3. Where liability is unable to be excluded due to legislative regulation or permitted by law, CommGear is limited to the re-supply of information supplied within the site and set out within our Policies

   4. CommGear makes no warranties, guarantees or representations that the material in this Site will not cause damage or that the material is free from any computer virus and other defects that are outside of our control

6. Spam

   1. Any publication of CommGear’s email addresses on the Site is to facilitate communications relating to the goods and services supplied by CommGear exclusively

   2. It must not be inferred as consent by CommGear to receive unsolicited commercial electronic messages

   3. Unsolicited emails will be reported as spam and blocked from contacting us further

Entire Agreement
The Terms and Conditions of Use, Privacy Policy and the Warranty, Returns and Refunds Policy constitute the entire agreement between the user and CommGear.
